Ronald Everson sued the DeKalb County School District and school officials after he was accused of stealing air-conditioning units, indicted for burglary, fired, and not reinstated after the charges were dismissed. He alleged that officials had relied on false information and that the superintendent had accepted improper payments connected to school construction. The trial court dismissed the complaint. The Georgia Court of Appeals affirmed dismissal of the claims against the School District and against the superintendent in his official capacity because sovereign immunity applied. It reversed dismissal of Everson’s individual-capacity claims against the superintendent for wrongful termination, punitive damages, and attorney fees. The court held that the complaint plausibly alleged a procedural due-process claim based on a property interest in continued employment, while a personnel manual did not itself create a contract and the substantive due-process claim failed. The court affirmed in part, reversed in part, and remanded for further proceedings on the surviving claims.
