Case Summary

Michael Russell was convicted of malice murder and related offenses in Christy Waller’s death. He challenged the admission of statements, the jury instructions, counsel’s performance, and the sentence imposed on one count. The Georgia Supreme Court affirmed the convictions and most of the judgment. It held that the trial rulings and counsel claims did not require a new trial. The court also corrected a written-sentence scrivener’s error and remanded for that limited correction. The disposition was therefore affirmed in part and vacated in part, with a partial remand. One justice did not participate.
