Case Summary

David Sharpe was convicted of felony murder and related offenses after Devonte Coney was killed. He alleged ineffective assistance because counsel failed to object to testimony from a GBI special agent and failed to poll the jury. The Georgia Supreme Court affirmed in part and reversed in part. The court rejected Sharpe’s claim concerning the agent’s testimony, finding no deficient performance or prejudice. It held, however, that the record required correction of the judgment on another issue and vacated the affected portion. The remaining convictions and sentences were left intact. The limited reversal did not require a new trial on the murder charge.
