Case Summary

Orlando Smith was convicted of felony murder and firearm offenses arising from the shooting death of Demetra Smith. On appeal, he challenged the sufficiency of the evidence, the admission of evidence obtained during the investigation, the admission of bad-character evidence and hearsay, and the denial of a mistrial. The Supreme Court of Georgia held that the evidence was sufficient and that several objections were not preserved because Smith did not obtain a ruling or did not state the specific ground at the proper time. The court further held that the challenged character and hearsay evidence did not warrant reversal under the applicable standards and that the trial court did not abuse its discretion in denying a mistrial. The court affirmed the convictions and the corrected sentence.
