Case Summary

During a 2017 college-football game at Mercedes-Benz Stadium, a fight broke out; Lynda Soundara approached, fell, stepped away, then removed a sandal and re-entered to help her fiancé before Charles Kraver Jr. grabbed her hair and slammed her down. She sued the stadium entities and their security contractor for negligence and sued Kraver Jr. and his son for assault and battery. The Court of Appeals affirmed summary judgment for the stadium defendants and security contractor because video showed Soundara knowingly re-entered an obvious, ongoing fight, so assumption of risk barred her negligence claims. It reversed summary judgment for both Kravers: assumption of risk does not defeat intentional-tort claims, and the record did not resolve Soundara’s claim that the son acted in concert with his father. The court affirmed in two appeals and reversed in the third.
