Case Summary

The National Labor Relations Board sought a temporary injunction under Section 10(j) of the National Labor Relations Act requiring Starbucks to reinstate employees while administrative proceedings continued. The Supreme Court held that courts must apply the traditional four-factor preliminary-injunction test, including likelihood of success on the merits and irreparable harm. Section 10(j)’s authorization of relief deemed just and proper did not replace the ordinary equitable standard with the more deferential test used by the Sixth Circuit. The judgment was vacated and the case remanded.
