Case Summary

Georgia and several other states appealed the denial of a preliminary injunction seeking to prevent enforcement of the federal Waters of the United States Rule under the Clean Water Act. While the appeal was pending, the Supreme Court issued a decision affecting the jurisdictional framework for challenges to the rule.
