Case Summary

The State challenged a trial-court order suppressing evidence of Antonio Randall’s refusal to submit to a warrantless blood test in a driving-under-the-influence prosecution. The trial court had held that Georgia’s implied-consent statutes violated due process by allowing refusal evidence to be admitted at trial. The Supreme Court of Georgia vacated that ruling. It held that the trial court had applied an incorrect constitutional analysis to the implied-consent scheme and directed that the ruling be reconsidered under the governing law. The Court’s order left the suppression issue to be resolved in accordance with the corrected framework.
