Case Summary

Steven Odum appealed orders arising from a custody dispute with Peggy Russell. The trial court left the parties’ joint custody arrangement in place, awarded Russell attorney fees under one statute, awarded additional fees under another, and dismissed Odum’s initial notice of appeal. The Georgia Court of Appeals reversed the provisions of the final order that modified custody because the evidence did not support the changes under the governing best-interests and changed-circumstances standards. It affirmed the fee award under one statute, but vacated the separate fee award because the trial court did not make the findings required by the applicable provision. The court held that the later appeal rendered dismissal of the earlier notice moot and remanded for further proceedings concerning the vacated fee award.
