Case Summary

Desean Subar was convicted of malice murder and related offenses arising from crimes against three victims. He challenged the admission of a prior burglary and alleged ineffective assistance of counsel. The Georgia Supreme Court affirmed. The court held that the prior burglary evidence was admissible for the purpose identified by the State and that, in any event, its admission was harmless. The jury already knew of Subar’s prior burglary-related status from evidence offered to prove other charged offenses, and the evidence of guilt was strong. The court rejected the ineffective-assistance claims and left the convictions and sentences intact.
