Case Summary

Christopher Tallington was convicted of trafficking a minor for sexual servitude and several related sex offenses after evidence showed that he recruited a 14-year-old runaway into motel-based prostitution, took explicit photos of her, monitored her commercial sex encounters, and kept the proceeds. On appeal, he challenged both the sufficiency of the evidence and trial counsel's performance, including counsel's failure to pursue suppression arguments aimed at a phone tied to the Backpage ads. The Court of Appeals of Georgia affirmed. It held that the victim's testimony was sufficiently corroborated and that the surrounding digital, photographic, and physical evidence strongly supported the convictions. It also concluded that Tallington failed to show prejudice from counsel's strategic choices because the proposed suppression theories, including his attack on the phone warrant, would not likely have succeeded.
