Taylorv.The State
Mark Antonio Taylor was convicted of murder and related offenses after he took a truck from a car dealership, forced an employee at gunpoint toward the building, and shot him twice. On appeal, Taylor challenged counsel’s jury-selection decisions, the use of evidence about an altercation with his girlfriend, and testimony concerning self-defense. The Supreme Court of Georgia held that counsel’s limited questioning and strategic decisions about juror strikes did not show deficient performance or prejudice. It also held that the State could cross-examine Taylor about the altercation to disprove his misleading account of why he had left his girlfriend’s car; the questioning was impeachment, not an improper use of character evidence. Finally, Taylor could not challenge self-defense testimony that his own counsel deliberately elicited. The evidence was sufficient, and the court affirmed all convictions.
