Case Summary

Lanette Jones sued attorney Terry Jackson after he retained a contingency fee from the settlement of a wrongful-death claim involving Jones’s son. The Georgia Court of Appeals reversed the denial of Jackson’s motion for summary judgment. The court held that the governing Georgia statute allowed Jones to bind the claimant to the contingency-fee agreement despite her refusal to proceed, and that her conduct showed an intent to be bound. Because the agreement controlled the fee dispute, Jones’s conversion and punitive-damages claims could not proceed on the pleaded theory. The court directed judgment for Jackson.
