Case Summary

The Medical Center of Central Georgia and related parties challenged a superior-court judgment reversing an administrative decision about a diagnostic-equipment threshold for a medical complex. The superior court had ordered the Department of Community Health to investigate the complex’s spending and had rejected the agency’s treatment of the equipment. The Court of Appeals reversed. Under the Administrative Procedure Act and the governing health-facility statutes, the reviewing court could not substitute its judgment for the agency’s on factual matters when the agency’s decision was supported by the record and consistent with law. The appellate court held that the diagnostic equipment fell within the applicable statutory treatment and that the superior court’s contrary order exceeded the proper scope of review. It also denied a request to vacate and remand the judgment for a separate procedural reason. The superior court’s judgment was reversed, leaving the agency’s final decision in place. Two judges concurred.
