The State appealed a renewed order suppressing Dijon Abbott’s statements after an earlier Georgia Supreme Court decision established the governing rule for police use of a two-step interrogation technique. The trial court again suppressed Abbott’s post-warning statements, finding that he had not knowingly and voluntarily waived his rights. The Georgia Supreme Court vacated and remanded. The court held that the trial court had to apply the controlling Seibert and Norwood standard to determine whether the post-warning statements were admissible. The renewed order did not show that the correct legal standard had been applied, so the Supreme Court directed the trial court to reconsider the statements under that standard. The Chief Justice concurred in the judgment only.
