Case Summary

The State sought to introduce evidence of other sexual acts in two pending prosecutions charging Arafat Chowdhury with rape and aggravated sodomy involving different victims. The Court of Appeals of Georgia held that some of the proposed evidence was admissible under the governing other-acts statute, while other evidence was properly excluded on the limited pretrial record. The court affirmed in part and reversed in part. It also rejected a claimed legal bar to trying the cases separately while admitting relevant other-acts evidence, explaining that admissibility and severance are related but distinct questions.
