Elgerie Cash and Jennifer Weathington were convicted of murder and related offenses after Lennis Jones was shot in Cash’s home. The trial court later granted new trials on general grounds, and, after the Supreme Court of Georgia affirmed that ruling, it sustained the defendants’ double-jeopardy pleas and dismissed the charges for insufficient evidence. The State appealed. The Supreme Court of Georgia held that the State’s appeal was authorized because the order sustained a plea in bar before a retrial, and that the defendants had not waived review of the legal sufficiency of the evidence. The evidence, viewed under the Jackson standard, authorized a rational jury to find both women guilty: their account that Jones shot himself conflicted with the physical scene, and their conduct before and after the shooting supported a finding that both aided the killing even if the evidence did not identify which woman fired the shot. The court reversed the order sustaining the plea in bar and remanded.
