Case Summary

Three former sheriff’s deputies were charged with felony murder and related offenses after Eurie Lee Martin died. Each sought statutory immunity, asserting that the shooting was justified in defense of self or others. The trial court granted immunity, but the Georgia Supreme Court vacated the rulings and remanded. The court held that the trial court’s factual findings were inconsistent with its legal conclusions about the encounter and that the findings did not permit meaningful appellate review. The trial court had to reconsider the immunity motions under the governing justification standard and resolve the material facts consistently with its legal analysis. The Supreme Court did not decide whether the deputies were ultimately entitled to immunity.
