Case Summary

Following his arraignment on a nine-count indictment, Tommy Lamar Thomas timely filed a special demurrer challenging the descriptions of two counts charging possession of a sawed-off rifle and a sawed-off shotgun. The counts tracked the statutory labels and dimensions and said the weapons were separate from those in other counts, while another count identified a Hatfield shotgun by make, model, and other details. The trial court denied the demurrer, certified immediate review, and the Court of Appeals granted an interlocutory appeal. The court held that a timely special demurrer entitles a defendant to an indictment sufficiently specific to prepare a defense and guard against a later prosecution for the same offense. Because the two counts did not identify the particular firearms, the State could not rely on discovery or its assertion that only two weapons were involved; the descriptions had to include distinguishing details such as make, model, caliber, serial number, or appearance. The Court of Appeals reversed the denial of the demurrer as to Counts Two and Three only. Quashing those counts bars trial on the defective indictment but generally permits the State to reindict with adequate descriptions, subject to the limitations period and statutory restrictions.
