Tyler Jarel Thomas was charged with murder after investigators obtained historical cell-site location information under a court order. The trial court initially suppressed the records, but later vacated that ruling after a new trial had been granted. Thomas argued that the common-law end-of-term rule barred the trial court from reconsidering its interlocutory suppression order. The Supreme Court of Georgia affirmed. It held that the end-of-term rule did not prevent the trial court’s reconsideration in these circumstances and declined to revisit the court’s prior understanding of the rule because that issue was not properly presented for stare-decisis analysis. The Court left the suppression ruling in place for further proceedings.
