Case Summary

Eric Thompson was convicted of two murders and a firearm offense arising from the deaths of Andre Geddis and Melody Keller. He challenged the admission of character evidence, evidence of a later attempted robbery, hearsay testimony recounting a victim’s telephone statement, the denial of a continuance, and the sufficiency of the evidence. The Supreme Court of Georgia held that the evidence was sufficient, including accomplice testimony corroborated by cell-phone records and other circumstances. It held that some challenged evidence was improperly admitted, including character evidence offered under the wrong statutory framework, and that the error required reversal. The court also held that a victim’s statement about waiting for someone to sell him a firearm was admissible under the residual hearsay exception because it was material, unusually probative, and supported by circumstantial guarantees of trustworthiness. The court did not resolve issues unlikely to recur on retrial. The judgments were reversed, although the evidence was sufficient to permit a new trial.
