Case Summary

A federal rule required special markings and voter-specific barcodes on federal election mail, plus voter information in a Postal Service portal. After a district court enjoined the rule, the Postal Service and federal officials sought an emergency stay. The Supreme Court denied it, finding the government unlikely to succeed on its challenge and the equitable factors unfavorable. Justice Kavanaugh agreed that the rule might fall within the Postal Service’s authority but said imposing it for the 2026 elections would be arbitrary and capricious because election officials lacked time to implement it. Justice Alito, joined by Justice Thomas, would have granted the stay.
