Case Summary
Erika Day was caught with methamphetamine and a handgun after deputies stopped her car, and she later gave substantial assistance by wearing a wire, making a controlled purchase, and testifying against suppliers. The district court departed below the five-year minimum for both the drug and firearm counts even though the government moved under 18 U.S.C. § 3553(e) only as to the drug count. The Eleventh Circuit held that the motion authorized a departure from one minimum, not the other, and vacated the sentence for resentencing.
