Case Summary
Terry Zimmerman was convicted of possessing child pornography after the jury heard about his 1995 federal conviction for the same type of offense. The Eleventh Circuit held that Federal Rule of Evidence 414 permitted the prior-conviction evidence and that the district court did not abuse its discretion or omit a required Rule 403 explanation. It also rejected Zimmerman’s unpreserved First Amendment challenge to an internet ban during supervised release, affirmed the conviction and sentence, and remanded only to correct a statutory citation typo in the judgment.
