Case Summary

After the Supreme Court of Georgia reversed an earlier Court of Appeals judgment concerning a conversion counterclaim, the Court of Appeals revisited the remaining portions of its prior decision in the litigation between Vinings Bank and Brasfield & Gorrie. The appellate court vacated its former Division 3 and adopted the Supreme Court’s judgment in its place. It left Divisions 1 and 2 binding because they were consistent with the Supreme Court’s ruling, including the rulings concerning priority of the bank’s assigned security interest and the bank’s conversion claim. The court granted Vinings Bank summary judgment on Brasfield & Gorrie’s conversion counterclaim and affirmed the balance of the trial-court order.
