Case Summary

Nathaniel Vivian was convicted of felony murder and related offenses arising from the shooting death of Daniel Zeitz. The Supreme Court of Georgia rejected his challenges to the evidence and trial rulings but held that the trial court improperly entered sentences on two felony-murder convictions arising from the same killing. Because one felony-murder verdict is vacated by operation of law, the trial court must determine which verdict remains and how the related convictions and sentences merge. The Court affirmed in part, vacated in part, and remanded for resentencing.
