Case Summary

Rickey Williams was convicted of felony murder for the shooting death of Lynett Karim. He argued that the trial court should have instructed the jury on mutual combat and that trial counsel was ineffective. The Georgia Supreme Court affirmed. The court held that the evidence and the parties’ conduct did not support a mutual-combat instruction. It also held that Williams failed to show deficient performance or prejudice from counsel’s handling of the case, including the advice concerning his right to testify. The trial record supported the finding that counsel advised Williams of that right and did not prevent him from testifying. Because a defendant who has been advised of the right to testify must communicate a desire to take the stand, the court found no constitutional violation. The court rejected the remaining claims and affirmed the conviction and sentence.
