Case Summary

A jury convicted Demetrius Willis of three murders and numerous related offenses arising from a 2004 Atlanta shooting that killed three people, including a child, and injured other children. The jury imposed three death sentences. The Supreme Court of Georgia affirmed the murder convictions and death sentences but vacated three aggravated-assault convictions and sentences. The court held that the evidence, including eyewitness accounts, the defendant’s admissions, blood evidence, clothing, and ballistics, was sufficient to support the verdicts and the statutory aggravating circumstances. It also conducted the required review for passion, prejudice, arbitrary influence, and proportionality and found no basis to disturb the death sentences. The court corrected the trial court’s use of merger terminology, explaining that certain felony-murder verdicts were vacated by operation of law and that three aggravated-assault counts should not have remained as separately sentenced convictions. The remaining convictions and sentences, including the death sentences, were affirmed.
