Womacv.The State
Lawrence Edward Womac was convicted of aggravated sexual battery, child molestation, cruelty to children, and false imprisonment after inviting a minor into his motel room and engaging in sexual conduct. He challenged the admission of evidence about prior sexual conduct, the sufficiency of the evidence, the merger of offenses for sentencing, and his life sentence for aggravated sexual battery under the Georgia Constitution’s prohibition on cruel and unusual punishment. The Supreme Court of Georgia held that the challenged evidence and the sentencing structure were legally proper and that Womac had not shown an error requiring a new trial. The court rejected his proportionality challenge because the sentence was not grossly disproportionate to the aggravated sexual battery established by the record. The court also held that the convictions involved distinct statutory elements for sentencing purposes. The court affirmed.
