Woods Et Al.v.Barnes Et Al. (Two Cases)
Public-school teachers challenged the application of a charter-school statutory waiver that exempted their school system from Title 20 protections under Georgia’s Fair Dismissal Act. They argued that the later Charter Systems Act impaired vested statutory and contract rights they had earned after the original charter legislation but before their school system converted. The Supreme Court of Georgia held that the challenge, as presented, failed. The original Charter Schools Act had already made clear that the Fair Dismissal Act did not create protections enforceable against charter schools, and the later legislation merely adapted the waiver language to charter-system conversions without materially changing its operation. Because the teachers had no impaired right against the charter system, the constitutional challenge could not proceed. The Court reversed the trial court’s denial of the defendants’ dismissal motion, its grant of summary judgment to the teachers, and its denial of the local defendants’ cross-motion. All justices concurred except one who was disqualified.
