Case Summary

Jermaine Young was convicted of malice murder and related offenses in the shooting death of a pizza-delivery driver. He challenged the admission of statements from police interviews, a Facebook photograph, and counsel’s failure to seek suppression of a search warrant. The Georgia Supreme Court affirmed. The court held that the challenged statements and photograph did not require reversal and that the warrant application gave the magistrate a substantial basis to find probable cause connecting a phone, Young, and the residence to the shooting. Young therefore could not show that a suppression motion would have succeeded or that counsel’s performance prejudiced him. The court also considered the cumulative effect of the claimed errors and held that it did not require a new trial. The court left the convictions and sentences undisturbed.
